The carGO mobile Application, website, and other technology (collectively, the “carGO Application”) is owned by and operated by applicable affiliates or licensees of carGO - Holdings, LLC, a Missouri limited liability company (collectively for purposes of this Agreement “carGO”). The carGO Application provides a technology platform that allows persons seeking ground transportation, delivery or other logistical services (“Users”) to select or match that User with persons willing to provide the User ground transportation, delivery or other logistical services (“Drivers”). The exchange between Drivers and Users for ground transportation, delivery or other logistical services arrange through the carGO Application will be called “Services”. You acknowledge that carGO does not actually provide the Services, but simply provides a forum with which you can engage as a Driver.
carGO may collect personal information about you when you create an account and use the carGO Application, carGO may use this information, as well as provide such information to carGO's service providers, for carGO's legitimate business needs. By submitting information when setting up your account and using the carGO Application, you consent to the collection and use of your personal information.
You agree that carGO may use location-based services when you use the carGO Application. You agree to waive and release carGO from any liability or claim for damages arising from your use of the carGO Application or related to the use of any location-based services.
You may have the ability to refer Drivers to partner with carGO in your market. To assist in doing this, we may request and you can grant access to your mobile device address book. You can direct carGO to send referral text messages or referral emails to select contacts in your address book. By sending any referrals to carGO you are also consenting to carGO sending your profile image to the contacts.
carGO works with one or more third parties to facilitate text messages between Customers and Drivers who are delivering the Customers’ food, alcohol, person, or products. We receive information about these communications including date and times of each text message or call. We also reserve the right to record these calls for quality assurance.
Customers and Drivers will be able to rate and review each other at the end of each and every delivery. Customers may be able to review the Drivers ratings at any time and you consent to this sharing of information. Customers may also provide carGO with information and feedback related to their experiences on the Platform.
Prior to a Driver picking up a delivery or rider, the Customer or Merchant may be able to see the Driver's real-time location.
carGO shares your information with service providers that perform services on our behalf, including all the uses described above.
carGO may disclose information about Drivers: (a) if, in carGO's sole discretion, disclosure is required by applicable federal, state, or local law, rules, or regulations including governmental requests; (b) if there is a complaint or dispute related to such Driver; (c) to enforce the terms of any agreement between carGO and such Driver; (d) if, in carGO’s sole discretion, disclosure is required to protect the safety or security of any User; to detect or prevent fraud, security or technical issues; and to prevent or stop any activity that carGO considers to be, or poses a risk of being, illegal or unethical; (e) to protect the security or integrity of the carGO platform; (f) to defend ourselves or others against third party claims and allegations; (g) while negotiating a business transaction such as a merger, sale of assets, or bankruptcy; (h) when you consent to sharing in any other circumstance not provided for in this agreement.
